obispo county. he was's prepared yesterday afternoon. he was on the run since wednesday when he walked away from the work detale outside the prison secured perimeter a short time later investigators say mendoza carjacked a woman at a home depot parking lot in san rafael. friday the victim told kpix about her terrifying ordeal. >> he said give meet key. i have a gun and if not i am going to kill you. he do like this. i have the gun. give meet key if not emgoing to kill you. he jumped into the car and then i asked him can you return my dog. >> and she says mendoza let her take her phone and dog before he sped away. the california highway patrol found the suv abandoned on highway 101 about 40 minutes earlier he was spotted buying clothes in san miguel. detectives believe he tried to make it to los angeles. that's where he earned the five year sentence was serving for carjacking. an arrest of a man suspected of killing a police

officer in the stanislaus county of newman is adding to the immigration debate e killed ronil singh during traffic stop. after 2-day manhunt he was found. the 33-year-old surrendered to s.w.a.t. team officers about 200 miles away from newman near bakersfield. 7 more people have been arrested for helping arriaga hide from police including his brother, girlfriend and coworker. stanislaus county sheriff says he was in the u.s. illegal and was trying to flee to mexico when he was caught. christiansen blames the sanctuary state law for the death of corporal singh. a final farewell in the central valley. the 2-year-old boy who reignited the debatep on the travel ban was laid to rest yesterday. >> family and friends chanted prayers in lodi as abdulla

hassan's body was lowered in the ground. he was born with a rare brain disease and came to the u.s. with his father to get treatment. both are u.s. citizens. but his mother was unable to visit because of the trump administration's travel ban. after a long legal battle she was finally entered allow to enter the u.s. >> they were very close to seeing the unimaginable which was being separated while their baby died and we are very relieved that it didn't happen. but at same time i. think all of us are thinking if this muslim ban was not in place to begin with, abdulla and his mother would have been here over a year ago. >> his here was granted a visa that allows her to stay in the u.s. indefinitely. police have identified a suspect wanted for robbery and attempted murderer in san francisco. they say he is 25-year-old melton earl kelly from oakland. the search is underway to find him. here's newly released video of the attack. the victim was beaten and stomped and lost consciousness. this all happened in san francisco.

the partial shut down the federal government continues. and it is cause problems in the bay area including the golden gate national recreation area. yesterday, people trying to get to the beach in marin county found a traffic mess. parking lot was locked up and empty and that led to traffic jams and fender benders on nearby narrow roads. and all of this caused frustration for locals and visitors. >> especially with how many tourist there are at this time of the year and how beautiful of a day it is. it's ridiculous they are shutting down a big parking lot and causing a traffic jam. >> with the parking lot locked up, people parked inneighborhoods where the parking is tight. shut down has been going -- has been going on for week. the president and democratic law makers are in a stand off for a funding for a border wall. environment protection agency has begun to furlough workers and the shut down is forcing hundreds of thousands of federal employees to stay home or work without pay. and u.s. senator harris is reportedly inching closer to

announcing a 2020 presidential run. according to the "new york times" harris is considering baltimore or atlanta as location for her presidential campaign headquarters. the oakland born senator will likely name her 2016 senate campaign manager juan rodriguez to head up her presidential bid. and the times reports that harris' team is reviewing the senator's paper trail to make sure she is not pokesed to any political you will have glerkts new this morning, fairfield police are look for two suspects in an armed robbery that injured one person. police say it happened last night in the parking lot of a restaurant on oliver road when the victim was approached by two men attempting to rob him at gunpoint. the victim fought off the two men and was injured when the gun went off. both suspects fled the scene. and the victim is recovering in hospital. oakland's monthly first fridays have restarted after gun vile enshut down the event. last october 5 people were injured when a gun fight broke out after the eventch the festival restarted in december but had few people attending. now this january, organizers are hoping for more foot

traffic at the family event with more security guards present and authorities cracking down on people drinking in the streets nearby. the event is on january 4th. the theme is community. governor brown has issued a record number of pardons and commutations as his final term in charge of california draws to a close. we asked welly brown about why the governor has been doing this. >> well, jerry is moving into a whole new world. he is thinking seriously about what happens after he is left the job and he really is dedicated to prison reform. and he believes there's so many people in jail who shouldn't be there. it's so costly to the state that where appropriate, and he's defined appropriate as if you know i can no longer say a vilage priest but that's lack appropriate but something short of a village priest he will release you. >> it has a lot to do the with the trump administration so many of the pardons were people

who are in the u.s. illegally who may be subject to deportation based on their criminal history. >> pardon hour however is. >> he hopes it will save them. >> that might save them but they have been released or served their time a pardon comes after you served your time and is a forgiveness. and usually follows years and years of doing good works or being on the street. commutations is letting people out of jail or getting them off death row. >> he did far fewer commutations. >> but mayor brown over the course of his administration, he made a concerted effort to drive down the population of prison. how much of this is philosphicalalan how much is trying to save money. >> with him, i believe it's totally and completely his commitment to making the criminal justice system work. he has always spouted about our awful the system. and how many times we have simply used the world of politician to enhance. sentencing and how in fact it has had zero effect on what

happens with records to crime and punishment. >> how much is do you think it's because he is outgoing and not come back as opposed to gavin newsom. >> someone who has to answer forthe thousands of people who he pardoned and the hundreds he commuted is very different situation. he has done it so much the state supreme court has taken the incredibly rare step of sort of blocking 6 of these. something they haven't done since the 1930s. they are calling it an abuse of discrest so he's gone pretty far field. >> this is serious with him. he really is dedicated to theideal that clearly the system needs to be put back in place as it was when his father was the attorney general. >> that's a interesting . you made about the state supreme court. i was under the impression that the pardon power of the governor was, you know, was something that could not be challenged. >> well, the state supreme

court for a long time has believed it has a extra special step. it is nowhere in actual law they just believe that as the state court, they can review these kind of pardons and commutations for what they call abuse of discretion. it's something they believe they have. it hasn't been challenged any further. but, 6 after not doing any of this for since the 1930s is pretty significant. but the brown administration doesn't challenge the court's ability to do that. they sort of dropped the matter once the courts have made the rulings. so. >> all right. >> yeah. >> and still to come how long will the shut down go on. phil matier talks with local congressman. >> safety precautions to tech folks at the biggest new year's eve celebration. ♪ not long ago, ronda started here. and then, more jobs began to appear. these techs in a lab. this builder in a hardhat... ...the welders and electricians who do all of that.

of donald trump and nonfunctioning congress. what is the issue at loggerheads is it the border or the wall security is that what this is all about. >> no. if we actually listen to the experts we wouldn't spend the mondayity way he wants to but it's good optic for the political base so we are stuck in the fighter with wants us to appropriate $5 billion for a wall that has not been studied and we don't know if it will be effective we should ask for an analysis. >> we should be back in washington leadership meeting around the clock to try to resolve this issue. you have 800,000 federal employees. >> yep. >> and it's the holidays now. but in a couple days people are going to be going back to work and want their passports renewed and immigration and they are not going to want to see closed sign. >> it is costing billions. >> why can't they -- are both sides just so entrenched they just -- they are willing to go for the optics over getting the government back. >> no this is what happens when we put our narcissistic

embowsol in charge. >> that's a talking point but the other. >> no. no it's a reality. >> okay. it's reality but the other side would say okay you guys this is what happens when you put a bunch of people on that don't want a border discussion don't want to have security on the borders. and they are answering to their own bases. >> that's not accurate. we have multiple bills that are bipartisan. will herd a republicans who represents the largest portion of the border from texas, he has a bill with democrat pete aguilar from california. one on a vote. it would begin to solve the problems. so if you had a functioning federal government that was not driven by someone who wants to drive the american people apart we would have a compromise bill and that bill exist today if it was on the floor for vote. it would pass. >> but the last time the bill went on the floor for the vote. >> that never this bill never has been on the floor. >> but the last time that the democrats were going to stop the bill from going forward nancy poliosi said the republican idea and she didn't it pass. >> you are separating issues.

the bill that the republican put on the floor and passed nancy said they didn't have the vote for they turned out and did was the appropriations and that had the border wall in there. now this is why it gets it's more complicated that it appears. the wall is a nice symbol to president of the united states. but the experts say that's not where they want us to spend the money. there's more effective ways. this is a over 2,000 stretch of land we are talking about. and it is not most effective way to build a wall. sounds good the chinese did it. a long time ago. >> how long do you see this going on? >> well we will get in charge next week, so when we get in charge my expectation is we would pass a bill that the senate passed and that the president had agreed to that has funding reopens government and has funding for border security but not for the stupid wall. >> you see it ending next week? >> well what will happen is i think this bill will pass out, with democrats in charge and go back to mitch mcconnell and it will be the same bill they passed out unanimously two weeks ago that the president had agreed to.

than he got up in the morning and heard his neo conservatives on tv saying he was a sellout and he flipped. so it's very hard to bargain. you watch politics. for all of our shortcomings tough have a certain amount of trust and right now there is no trust because of the president of the united states. >> and how long do you see this going on? >> hopefully it will be done next week. i mean that's my hope. there has to be a reality check here. and that's what we have to come to. i would be willing to spend more money on border security if we had general accounting office come in and say this is how you spend tight make the boarder -- border more secure. >> do you see it going on for 2 or 3 weeks. >> with this president who knows a rational person in that office would come to a compromise. we are willing to compromise. >> okay. all right. we are going to -- can you stick around for a little bit because i would like to talk about the wall and the funding and border security. >> okay. >> which is the hot topic but we are going to look at weather. i think we went over time. let's look at the weather. thanks, bill.

we are looking at a chilly start this morning. and we do have a little bit of fog and low clouds out there. in some location right now. concord at 38. 47 in oakland. 47 in and fran. 39 san hoe -- san francisco. 37 in san jose. and 33 in santa rosa. satellite perspective showing we are us. sunny and dry through 2019. high pressure in place that is going to keep the rain at bay. futurecast shows not much in the way of cloud cover. tuesday new year's day as we advance out farther into next we we see the storm track get closer staying dry through the extended forecast through at least the next 7 to 10 days. temperatures do stay mild high temperatures in the mid to upper 50s for most location near 60 for at couple of the warm spots. 59 at pacifica. as well as san rafael.

58 in vallejo and fairfield. 59 napa. 60 today in santsa rosa. so here's what to expect. as you make your way through the day. partly cloddy and chilly to start. sunny and windy. the story today through new year's day. and then, our highs do remain in the mid-50s. which is seasonably cool. this is where we should be this time of year. new year's forecast, you make the plans, grab a sweater. we are going to see temperatures in the low 50s. this is for san francisco. temperatures by the bay. low 50s around dinner time on new year's eve. by midnight, and time for the fireworks shows, dipping down into the upper 40s by the bay. clear and cool. but as you head inland, the temperatures drop in the low 40s. chilly and breezy around midnight on new year's eve. if you are heading out and about today, downtown san jose mostly sunny. 58 for you there. and holiday ice rink in bark darrow center mid-50s. it will be cool. and the same is true for walnut creek on ice.

mainly sunny. mid-50s for you there. union square ice rinks san francisco mainly sunny and mid- 50s in union square. looking at the extend forecast, we don't see a lot of fluctuation. we are talking mid to upper 50s for highs through the extended forecast. no rain in sight. the big weather story the significant change we will see over the next couple days, that's going to be the wind. kicking up today and continuing through new year's day. so, might impact some of the fireworks shows but at least the skies will be clear. >> excellent. thanks so much, julie. a possible malwar attack disrupted tribune news papers throughout the con. >> over the weekend a computer vie royce infected "los angeles times" and san diego tribune systems. this morning tribune publishing reports the same disruption with the chicago tribune's production and multiple other tribune news papers. the problem impacted completeness of prined papersch websites and mobile applications have not been affected. and let the parties begin.

outside right now we have a few clouds you can actually barely see the skyline there because the clouds have moved over the sales force tower camera. temperatures are in the low 30s and we are freezing in santa rosa. 39 san hoe say. 38 concord and 40s for san francisco. and oakland at this hour. wind advisory goes into effect this evening and continues through new year's day. and we look at wendy conditions from the bay area hills and mountains, winds 20 to 35 miles per hour. and with gusts upwards of 70 miles per hour in the higher elevation that is could see downed trees and power lines down as well. new year's forecast, first, well, we will see windy conditions for new year's eve. around dinner time temperatures in the city and around bay going to be in the low 50s. and then, we are talking upper 40s around midnight. that's by the bay. which of course moderates temperatures colder though as you head inland. take a look at your midnight forecast around the bay area. along the coast, upper 40s as well as by the bay. but low 40s inland. chilly and breezy. we will have the full forecast coming up in just a bit. including what to expect for the next couple days.

and in the meantime, back over to you guys. san francisco base pg&e could face manslaughter charges and murder if found responsible for sparking the deadly campfire in butte county. that's according to state attorney general javier becerra nt. and the company is looking at the potential of paying out billions of dollars in civil damages. for more now from kpix5. >> if we want to get at the heart of justice, over these fires that we have seen, we need to have some action taken. >> reporter: cal fire is still investigating what caused the campfire. which killed 86 people. but if pg&e is liability state attorney general says prosecutors could filed criminal charges against a company. and the severity of the charges all the way up to murder depends on the degree of malas or negligence. >> -- malice or negligence. >> even if it's murder conviction against the corporation corporation. corporation is not going to prison. nobody is going to prison. >> reporter: retired judge says

you can't jail a corporation. pg&e has 6 felony convicts from the san bruno gas pipeline explosion. as a result, the company paid fines, performed community service, and is currently on probation. a new criminal conviction could mean a longer probation period. >> customers want to see actual people held accountable. >> reporter: minedy is with the utility reform network weighed vow cates for ratepayers. >> pg&e doesn't seem to have gotten the message. last time and the board of directors did very little to clean the company up. >> until someone goes to prison, for these action we are not going to see the change this culture. we are not going to see a change in behavior unless someone actually spends sometime behind bars. >> reporter: legal experts say even if company is liable it's unlikely prosecutors would go after pg&e executives. nonetheless, a criminal case against the big utility could lead to state take over or even a break up of the company.

particularly on issues, jerry brown has been very effective at spending his money. so, all of the people that think we have last seen jerry on his way to colusa, forget it. he is coming back to san francisco on tv. locally and nationally. and he is going to be incredibly active in my opinion in ever hey way. it wouldn't surprise me if during the course of newsom swearing in he gives the exit speech. >> to be sure. i don't think they will think he is going to farm in colusa. he's just far too interested and too active be a has so much money sitting around he can do things with. i don't think there's any chance unless he want to run for the mayor of colusa which is the kind of thing he tends to do when he is bored. >> but keep in mind, that he is now the symbol worldwide right up there with bloomberg and a couple other people on climate control. and he's far ahead of everybody else in california in many

other candidates for president on the issue of nuclear weapons and the things nuclear warheads and things of that nature. and if he adds to that reform if i am garcetti, newsom, harris, i would be concerned there may be another cat on the scene for president. >> it's just not a segment with willie brown without a plug for jerry brown for president i think he thinks we get a job in the administration. >> but 80 right? i mean that's probably the most greatest limiting factor is just his age at this point. >> you got to be believe if he was 20 years younger, 25 years younger, we defendant fetly be at -- definitely be at the top of the list in terms of protension presidential candidates but now bernie sanders is running into this and joe biden is running into this issue. so, i think the other issue for injury brown is it's hard to imagine him. you seen him work up a crowd? >> not so much. >> yeah. it's not really a crowd worker upper. i feel like that's a bit of

what a presidential candidate should be able to do. >> yeah. very true. all right. moving on a last-minute bid submitted to keep the retail chain sears from closing its doors for good. a hedge fund run by the sears chairman submitted a 4.4 billion dollar bid in an effort to keep the 425 stores open and 50,000 people working. friday, sears announced the closing of 80 more stores adding to the 182 stores already slated for closure. the bid is still awaiting for approval and a court hearing is scheduled for mid-january. sears operates k-mart stores. and still to come, wall debate dividing america. can president trump and capitol hill lawmakers actually reach an agreement? >> and get ready san jose. football fans from across the nation are coming to your city.

likely show you that as well. we are talking about the wall. and the government shut down that over the wall. and border security. now, we have a product -- we have policies and we have the wrapping around the policy. the question is border security especially in light of what has happened in california in the shooting of the policeman this weekend and the subsequent arrest of three people possibly illegal. here in the united states. what is the deal with the wall? why are the democrats so opposed to it? >> well, i would say the real deal is we have an immigration crisis. we need to have a discussion and a bipartisan discussion on immigration policy in this country. and the wall is part of that. so, the reason we don't want to spend the money on the wall is we are told by experts it's ineffective way to actually secure the border. so we need more staff down there. i've been down there. we need more judges and more border patrol people to process these record number of asylum seekers. >> okay. so, you want to process them and have them come into the

united states. >> no. no. no. they are allowed legally under a law from 1980 to seek asylum if they are under dures in their country of or judge. 20% of the people that apply get that. that's a system that has been work but it is stretched us about we went from 5,000 seeking asylum 10 years ago to now almost 100,000 people because of what's happening in central america. that's a functional problem that we should address and fix. >> okay. when we are talking about addressing and fixing. let's stay on the border. and border security. how much are democrats willing to spend on border security he wants $5 billion. and that's going to the wall. how much is democrats willing to spend. >> the package senate passed with an agreement with the president two weeks ago is 1.6 billion. >> why not more if it's such a pressing need is 1.6 billion enough or do we need more? >> we want to know where it's going and want experts to tell us how to spend it. >> who are the experts. >> general accounting office. >> how much do they say we should be spending.
